What happens before the Mediation?

Step 1

One party proposes mediation to the other side and nominates mediator(s)

Step 2

The parties agree which mediator to use.

Step 3

The mediator is instructed and the mediation date and venue are agreed.

Step 4

The mediator sends out the Agreement to Mediate (the mediation contract between the parties and the mediator) and invoices for his/her fees.

Step 5

The parties agree the mediation bundle and send it to the mediator.

Step 6

The parties exchange position statements.

Step 7

The mediator calls each side's solicitors for a confidential discussion about the case.

Step 8

The mediation takes place.
