How much does it cost?
The fee is £300 plus VAT for the Mediator. In addition there is a £50 administration fee (no VAT). The total is therefore £402.50 (inclusive of £52.50 VAT).
Who pays the fee?
The parties are jointly responsible for the fee. They are free to agree any arrangement between regarding the fee however the first defendant will be responsible for paying the fee to Trust Mediation.
How long does it last?
mTDs are scheduled for two hours.
What if we run out of time?
With the agreement of the Mediator and all parties the time can be extended but a further hourly rate will be payable. If necessary and with the agreement of all parties a further mTD can be arranged.
Who makes the first call?
The Mediator will make the first call at the pre-arranged time.
How do I know what number to call?
The Mediator will give you the relevant phone number in advance however the Mediator is likely to make most of the calls.
Is it confidential and without prejudice?
Yes to both questions. See the terms of the mTD Agreement. An mTD is similar to a face-to-face mediation in this respect.
Is any agreement reached binding?
If agreement is reached the representatives of the parties will be responsible for drawing up a written agreement, in the terms of a consent order if appropriate. Once the agreement has been signed on behalf of the parties there will be a binding agreement, enforceable through the courts if necessary.
