trustMediation’s Mediation Agreement

Key features of the straightforward Mediation Agreement are as follows:

  • The mediation will be confidential.
  • All discussions and all documents and communications prepared for or exchanged during the mediation will be without prejudice.
  • The mediation will terminate after four hours.
  • The Mediator shall be immune from any action and shall have no liability arising from the mediation.
  • The Mediator will not give legal advice to either or both Party(ies).
  • Any amendments to the Agreement or the Rules must be in writing and signed by the Parties and the Mediator.
  • There are provisions for fees and cancellation fees if the mediation does not take place.
